In exchange for your access to and use of the Platform, you agree as follows:
(a) you are of legal age and possess the legal capacity to accept these Terms, or you are accessing and using the Platform under the supervision of a parent, guardian, or other adult who has such capacity;
(b) to supply accurate, up-to-date, and complete information whenever prompted during registration on the Platform (“Registration Data”), regardless of whether such details are specifically requested by Brain Bashers Tutors;(c) to safeguard the confidentiality of your password and account credentials;
(d) to keep your Registration Data and any other information provided to Brain Bashers Tutors current, accurate, and complete by making prompt updates when necessary; and(e) to allow Brain Bashers Tutors a period of two (2) months from the date it publicly announces any data breach or potential data breach to remedy such breach or potential breach. (f) that Brain Bashers Tutors cannot verify the age of every person who accesses the Platform and therefore may not detect users under the age of 13. You are strictly prohibited from using the Platform, accessing its services, or submitting any content if you are under 13 years old, unless supervised by a responsible adult.

You bear full responsibility for all content you upload, post, transmit, or otherwise make available through your use of the Platform (“Content”). You agree not to upload, post, or transmit any Content that:
(a) is false, misleading, harmful, obscene, pornographic, defamatory, discriminatory, violent, offensive, harassing, or otherwise objectionable in the reasonable opinion of Brain Bashers Tutors or other Platform users; (b) discloses someone’s personal information without proper authorization; (c) infringes or violates any person’s or entity’s intellectual property rights; (d) is designed or intended to bully, insult, intimidate, or humiliate any individual; or (e) contains viruses, malicious code, vulnerabilities, or any other harmful programs, scripts, or files intended to damage, interfere with, disrupt, or limit the operation of any computer system, software, hardware, or telecommunications equipment.

Brain Bashers Tutors reserves the right, at its sole discretion, to edit, remove, or refuse to publish any Content that breaches these Terms, includes third-party commercial advertising, or is deemed inappropriate for any other reason.

Without limiting the foregoing, you agree to use the Platform in a lawful, appropriate, and respectful manner consistent with the purpose of any forums, groups, or features available on the Platform. Brain Bashers Tutors may, in its absolute discretion, determine that certain conduct is inappropriate or offensive (and may revise the examples below without prior notice), and such conduct may result in immediate suspension or termination of your account, with or without prior warning. Examples of prohibited conduct include, but are not limited to:

– Defaming, abusing, harassing, harming, stalking, threatening, or otherwise violating the legal rights (including rights of privacy and publicity) of others;
– Publishing, posting, uploading, or distributing any profane, defamatory, infringing, hateful, offensive, obscene, or unlawful content, names, information, or materials;
– Using the Platform for any purpose that violates applicable local, state, national, or international laws or regulations (including wage, hour, and working condition laws);
– Uploading files or materials that infringe the rights of any third party, including intellectual property rights;
– Uploading files containing viruses, trojan horses, worms, time bombs, spiders, cancel bots, corrupted files, malware, spyware, adware, or any other harmful code that may damage, disrupt, disable, or overburden any device, system, or network;
– Taking any action that compromises the security, integrity, or proper functioning of the Platform;
– Attempting unauthorized access to the Platform, other users’ accounts, or any connected systems or networks;
– Advertising or soliciting the sale of goods or services for commercial purposes unrelated to the Platform’s intended use;
– Impersonating any person or allowing another individual or entity to use your account credentials;
– Repeatedly posting the same content in a manner that constitutes spamming;
– Downloading files posted by another user when you know or reasonably should know that such distribution is illegal;
– Accessing, downloading, or copying any content or materials from the Platform using automated means (including bots, scrapers, spiders, hacking tools, or similar technologies);
– Reproducing, duplicating, copying, selling, reselling, or otherwise exploiting any content or materials available on the Platform without authorization; or
– Restricting or interfering with any other user’s ability to fully access or enjoy the Platform’s features.

By using the Platform, you represent and warrant that you currently satisfy and will continue to satisfy the following eligibility requirements (“Eligibility Conditions”) for the entire duration of your use:
(a) you will comply at all times with all applicable laws and regulations;
(b) you possess the full right, authority, and capacity to accept these Terms and to fulfill all obligations herein, and where acting on behalf of a minor or an organization, you are duly authorized to do so in good faith; (c) neither you nor any person residing in your household: (i) has been the subject of any complaint, restraining order, or legal proceeding involving violence, abuse, neglect, fraud, theft, or any offense endangering the safety of others; (ii) has ever been convicted of any crime (felony or misdemeanor), including but not limited to sexual offenses, child abuse, or domestic violence; and/or (iii) is or has been required to register as a sex offender in any jurisdiction; and (d) neither you nor any person in your household is currently released on bail or on recognizance pending trial for any felony or misdemeanor, including sexual, child abuse, or domestic violence offenses.

If you become aware of any accusation or complaint (whether or not it resulted in formal charges or trial), you must promptly notify Brain Bashers Tutors before continuing to use the Platform or its services. You hereby grant Brain Bashers Tutors the right to immediately suspend or terminate your access without notice while it investigates and decides whether to reinstate your account.

By using the Platform, you acknowledge that Brain Bashers Tutors may rely on the truth of the above representations and warranties. You agree that Brain Bashers Tutors may update or revise the Eligibility Conditions at any time (with or without notice) and that you will either comply with the new requirements or cease using the Platform.

You are also responsible for ensuring that anyone who accesses the Platform via your internet connection or device is aware of, and complies with, these Terms and any other applicable rules.

You authorize Brain Bashers Tutors to verify the representations made above and agree that it may (but is not obligated to) conduct background checks, including criminal record checks, sex offender registry searches, address verification, motor vehicle records, identity verification, credit checks, and review of public records. You consent to the collection, use, and disclosure of information necessary for such verification.

You agree that Brain Bashers Tutors may, in its sole discretion, take any action it deems appropriate — including suspension or permanent termination of your access — if it determines that any representation or warranty has been breached. Brain Bashers Tutors is not required to provide you with any specific timeline for communicating its decision.

Notwithstanding the above, you understand and agree that Brain Bashers Tutors is **not required** to perform background checks on any user. However, it will, to a reasonable extent, monitor the Platform for unauthorized or illegal activity and take steps to discontinue such activity upon discovery.

You further understand and accept that Brain Bashers Tutors does not verify the accuracy or completeness of information provided by users and does not confirm whether any user satisfies the Eligibility Conditions. You agree that it is your sole responsibility to evaluate and conduct any necessary background, reference, or safety checks before engaging with other users.

Brain Bashers Tutors expressly disclaims, and you hereby release Brain Bashers Tutors from, any and all liability for any claims, controversies, injuries, losses, or damages arising from or related to:
(a) any inaccuracy, incompleteness, or untimeliness in a user’s Eligibility Conditions; (b) any misstatements or misrepresentations made by any user; or (c) any fraud, theft, or other harm you may suffer as a result of interacting with another user on the Platform.

Brain Bashers Tutors reserves all rights, including the right to remove any content it finds objectionable in its sole discretion. Suspected violations or improper conduct may be reported to Brain Bashers Tutors by email at admin@brainbasherstutors.com.
